New asylum regulations restrict eligibility for many asylum seekers at the U.S.-Mexican border

On June 7, 2024, the Biden Administration published an interim final rule setting out new regulations that greatly restrict the ability of individuals to seek asylum in the United States. Under these regulations, those who recently arrived in the United States without inspection or admission will be barred from applying for asylum, unless they meet certain, limited exceptions. The regulations further instruct that, to apply for asylum at the border, individuals must schedule an appointment at a U.S. Port of Entry via the “CBP One” mobile application. The CBP One application, first launched in October 2020, has been challenging for many to navigate—especially those who do not have access to a smart phone or internet.

Several immigrants’ rights organizations are already challenging the legality of these regulations in court.
