EB-1 Unavailability through September 2024

The DOS has announced that the quota for EB-1 preference category for fiscal year 2024 (October 2023-September 2024) has been exhausted.  No further EB-1 green card applications (I-485 applications or immigrant visa applications at the US Consulates) will be approved until October 1, 2024 when the new fiscal year starts.  Please note that typically, USCIS continues to accept newly filed I-485 applications for persons current per the current Visa Bulletin (see: https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin.html).

In past months, the DOS has noted high demand in this category and anticipated retrogression or unavailability in this and other employment categories.  It is possible other employment categories could become unavailable as well through September 30 – especially EB-2 and EB-4.
