President Biden authorizes Deferred Enforced Departure for Palestinians

On February 14, 2024, President Biden issued an order authorizing Deferred Enforced Departure (“DED”) for certain Palestinians in the United States, based on the finding that “many civilians remain in danger” in Palestine and, specifically, Gaza. This means that many Palestinians who were in the United States as of that date will not be removed to Palestine for a period of 18 months, subject to some eligibility exceptions. Importantly, Palestinians who are eligible for DED will also be eligible to apply for work authorization in the United States. On April 15, 2024, USCIS issued a Federal Register notice regarding the procedures for applying for work authorization and travel authorization.
