Supreme Court upholds Arizona law regarding unauthorized alien employment

On May 26, 2011, the U.S. Supreme Court upheld an Arizona state law that punished Arizona businesses for hiring undocumented immigrants. Specifically, the Court upheld a provision of the law that suspended and revoked business licenses of employers who were found to have hired undocumented workers. In addition, the Court upheld a provision that required all employers within the state to use the federal government's internet-based employment verification system, E-Verify. The Court found that neither of these provisions conflicted with or were preempted by federal immigration laws.

NOTE: This ruling does not indicate that the Supreme Court will uphold SB 1070, Arizona's contested law that authorizes police officers to demand proof of citizenship from suspected undocumented immigrants.
