On May 26, 2011, the U.S. Supreme Court upheld an Arizona state law that punished Arizona businesses for hiring undocumented immigrants. Specifically, the Court upheld a provision of the law that suspended and revoked business licenses of employers who were found to have hired undocumented workers. In addition, the Court upheld a provision that required all employers within the state to use the federal government's internet-based employment verification system, E-Verify. The Court found that neither of these provisions conflicted with or were preempted by federal immigration laws. NOTE: This ruling does not indicate that the Supreme Court will uphold SB 1070, Arizona's contested law that authorizes police officers to demand proof of citizenship from suspected undocumented immigrants.
